- Profile Information (Talent):If you are Talent, you may provide additional information for your public profile, including:

- Videos (demo reels, audition clips)
- Audio recordings (voiceovers, singing samples)
- Physical attributes (height, weight, eye color, hair color, measurements)
- Skills (acting, singing, dancing, specific talents)
- Experience (resume, past projects)
- Location data (city, province for casting relevance)
- Union affiliations (if any)
- Sensitive Personal Data: In some cases, and with your explicit consent, you may choose to provide sensitive personal data such as racial or ethnic origin (e.g., for specific casting requirements), or health data (e.g., specific physical conditions for a role). This will be collected strictly with your voluntary and explicit consent for specific casting purposes.
- Profile Information (Hirers): If you are a Hirer, you may provide:
- Company name, contact person name, company address, phone number, and email.
- Industry (e.g., film, TV, advertising).
- Communication Data: Records of your correspondence with us (e.g., support requests, feedback).
- Payment Information: If you subscribe to paid services, we collect payment details such as credit/debit card numbers and billing addresses. This information is processed by our third-party payment processors. We do not store full payment card details on our servers.
2.2 Data Collected Automatically:
- Usage Data: Information about how you access and use the Platform, such as your IP address, browser type, operating system, referring URLs, pages viewed, time spent on pages, and dates/times of access.
- Device Information: information about the device you use to access the Platform, including device model, unique device identifiers, mobile network information.
- Cookies and Tracking Technologies:We use cookies and similar tracking technologies to track the activity on our Platform and hold certain information. Please refer to Section 7 for more details.
3. How We Use Your Information
We use the collected data for various purposes, primarily based on the necessity for contract performance, legal obligations, our legitimate interests, or your explicit consent.
3.1 To Provide and Maintain Our Services:
- To operate and deliver the core functionalities of the Platform.
- To manage your account and provide you with access to features relevant to your account type (Talent or Casting Professional).
- To enable Talent to create profiles and apply for casting calls.
- To enable Hirers to post casting calls and search for Talent.
- To facilitate communication between Talent and Hirers.
- To process your payments for paid services.
3.2 To Improve Our Platform:
- To monitor and analyze usage trends and preferences to improve the user experience and functionality of the Platform..
- To develop new features, products, and services.
- To troubleshoot technical issues and ensure the security of the Platform.
3.3 To Communicate with You:
- Act as an agent, employer, or representative of any User.
- Guarantee any casting opportunities, bookings, or employment for Talent.
- Guarantee the quality, reliability, or suitability of any Talent or Casting Professional.
- Take responsibility for any agreements, contracts, or arrangements made directly between Users, including payment terms.
3.4 For Legal and Security Purposes:
- Act as an agent, employer, or representative of any User.
- Guarantee any casting opportunities, bookings, or employment for Talent.
- Guarantee the quality, reliability, or suitability of any Talent or Casting Professional.
- Take responsibility for any agreements, contracts, or arrangements made directly between Users, including payment terms.
4. Data Sharing and Disclosure
We may share your personal data with third parties in certain situations, as described below:
4.1 With Other Users (For Platform Functionality):
- Talent Profiles: Your public Talent profile information (e.g., name, photos, videos, skills, experience, physical attributes) will be visible to Casting Professionals using the Platform to facilitate casting.
- Casting Call Information: Information posted by Casting Professionals (e.g., company name, project details) will be visible to Talent.
- Direct Communication: When Talent and Hirers communicate through the Platform, information exchanged will be visible to the respective parties.
4.2 With Service Providers: We engage third-party companies and individuals to facilitate our Services, provide the Service on our behalf, perform Service-related services, or assist us in analyzing how our Service is used (e.g., hosting providers, payment processors, analytics providers, customer support tools). These third parties have access to your personal data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.
4.3 For Business Transfers: If UPSTAGE is involved in a merger, acquisition, or asset sale, your personal data may be transferred as a business asset. We will provide notice before your personal data is transferred and becomes subject to a different Privacy Policy.
4.4 For Legal Compliance and Protection: We may disclose your personal data if required to do so by law or in response to valid requests by public authorities (e.g., a court or government agency in Thailand). This includes:

7.4 Right to Restriction of Processing: You have the right to request the restriction of processing of your personal data in certain circumstances.
7.5 Right to Data Portability: You have the right to receive your personal data in a structured, commonly used, and machine-readable format and to transmit that data to another data controller, where technically feasible.

Our Platform is not intended for individuals under the age of 18. We do not knowingly collect personal data from anyone under the age of 18. If you are a parent or guardian and you are aware that your child has provided us with personal data, please contact us. If we become aware that we have collected personal data from children without verification of parental consent, we take steps to remove that information from our servers.

Our Platform may contain links to other websites that are not operated by us. If you click on a third-party link, you will be directed to that third party's site.
