Payment Terms
These Payment Terms govern all paid services and features offered by UPSTAGE ("we," "us," or "our") through its online casting platform, www.upstagecasting.com (the "Platform"). These Payment Terms are incorporated by reference into our Terms and Conditions and Privacy Policy. By subscribing to or using any paid services on UPSTAGE, you agree to be bound by these Payment Terms.
1. Services Subject to Fees
UPSTAGE offers various paid services and features, which may include, but are not limited to:
- For Talent: Premium profile subscriptions, enhanced visibility, access to exclusive casting calls
- For Hirers: Subscription plans for unlimited casting call postings, advanced search filters, direct messaging limits, or other premium tools.
Details of specific plans, features, and pricing are available on the Platform's dedicated "Pricing" or "Subscription" pages.
2. Pricing and Currency
2.1 Pricing: All prices for services are clearly displayed on the Platform. UPSTAGE reserves the right to change its pricing at any time. Any price changes will be communicated to you in advance (as per Section 10) and will only apply to future purchases or renewals.
2.2 Currency: All transactions on UPSTAGE are primarily processed in Thai Baht (THB). If you are paying from a different currency, your bank or payment processor may apply currency conversion rates and fees, for which UPSTAGE is not responsible.
3. Payment Methods
We accept various payment methods, including major credit cards (e.g., Visa, Mastercard) and other payment options as displayed on the Platform. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Platform. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed.
4. Billing and Invoicing
4.1 Billing Cycle: Fees for subscription services are typically billed on a recurring basis (e.g., monthly, annually) as selected by you during the subscription process. For one-time purchases, fees are charged at the time of purchase.
4.2 Automatic Renewal: If you subscribe to a recurring service, your subscription will automatically renew at the end of each billing cycle unless you cancel it before the renewal date. By providing your payment information, you authorize us (or our third-party payment processor) to charge your designated payment method for the applicable fees on each renewal date.
4.3 Invoicing: Upon successful payment, you will receive an electronic invoice or receipt via email. You can also typically view your payment history and invoices within your account settings on the Platform.
5. Refunds
5.1 General Policy: All sales are final. UPSTAGE generally does not offer refunds for services that have been purchased or subscriptions that have commenced, regardless of usage. This is due to the immediate access to the Platform's features and resources upon payment.
5.2 Exceptions: Refunds may be considered in the following exceptional circumstances, at UPSTAGE's sole discretion:- Technical Failure: If the Platform experienced a significant, prolonged technical failure that prevented you from accessing or using the core paid services for an extended period, and we were unable to resolve it within a reasonable timeframe.
- Billing Error: In the event of a demonstrable billing error caused by UPSTAGE.
- Legal Requirement: Where a refund is explicitly required by Thai law.
5.3 How to Request a Refund: To request a refund based on an eligible exception, you must contact our support team at support@upstagecasting.com within 7 days of the transaction date, providing detailed reasons and supporting evidence for your request. All refund decisions are at the sole discretion of UPSTAGE.
6. Cancellations
6.1 Subscription Cancellation: You may cancel your recurring subscription at any time through your account settings on the Platform. If you cancel, your subscription benefits will continue until the end of your current billing cycle, and you will not be charged for the subsequent cycle. No refunds will be provided for any unused portion of a billing cycle upon cancellation.
6.2 Effect of Cancellation: Upon cancellation, your account will revert to the free tier, and you will lose access to premium features associated with the cancelled subscription at the end of your current billing period.
7. Taxes
You are responsible for paying all applicable taxes, levies, or duties imposed by taxing authorities in Thailand or any other jurisdiction, associated with your use of the paid services. UPSTAGE will charge taxes where legally required to do so.
8. Delinquent Accounts
If any fees are not paid in a timely manner, or if we are unable to process your payment due to invalid payment information, UPSTAGE reserves the right to suspend or terminate your access to the paid services or your entire account on the Platform.
9. Chargebacks and Disputes
If you initiate a chargeback or dispute a payment with your bank or payment processor without first attempting to resolve the issue with UPSTAGE directly, we reserve the right to immediately suspend or terminate your account. You will be responsible for any fees or penalties incurred by UPSTAGE as a result of such chargebacks or disputes.
10. Price Changes
UPSTAGE reserves the right to change the prices for its services at any time. We will provide reasonable advance notice of any price changes by posting the updated prices on the Platform or by sending an email notification to the email address associated with your account. Such changes will take effect at the start of the next billing cycle following the notice.
